Law to guarantee salvadorans' right to property is extended

Since the State must ensure that the greatest number of salvadoran families become homeowners, as established in the Constitution of the Republic (articles 103 and 119), 76 deputies of the Legislative Assembly extended the Special Transitory Law for the Regularization of Lots and Plots for Residential Use.

This extension will be for 12 months in order to guarantee the right to property to the population that is pending this process and thus guarantee them legal certainty.

According to the parliamentarians, this law has achieved that more than 2,500 families have the deeds of their land, which means US$8.3 million that these families have as legal security. These families have not had their deeds for more than 30 years and have always had the nightmare of not being able to inherit their land, their houses.

On july 8, 2021, the Special Transitory Law for the Regularization of Lotifications and Parcels for Residential Use was issued. This regulation establishes that such commercialized land may be regularized in accordance with the provisions of the law.

In addition, the processes of registration of such lots are expedited, as well as the finalization of the processes that were already initiated under the transitory regime for such regularization.

For years, the problem of land legalization has existed and in a short period of time we have solved historical problems suffered by the population.

The land subdivisions not contemplated by the law: According to Article 2, all land subdivisions for housing use will be governed by the transitory regulations, except for the following: a) Projects classified as complete urbanizations type 1 and 2, in accordance with the provisions of Article 47 of the regulations of the Urbanism and Construction Law in relation to housing subdivisions and housing developments.
