The amendments will provide Salvadorans with enough legal certainty for businesses to comply with their obligation to respond for the defects of the products or services they have sold them.
According to the president of the Defensoría, Ricardo Salazar, "the guarantee is a fundamental element for consumers in order to have clarity of the scope and above all of the benefits when appealing to a guarantee for a good, product or service".
He also reported that, from june 2019 to october 2022, the Defensoría del Consumidor provided assistance to 18,506 consumers, in relation to the right to warranty, mainly in appliances, household items, telecommunications and motorcycles, among others.
The reform proposal contemplates increasing the period of time during which goods may be exchanged or returned. The current regulation establishes a term of 30 days.
Economic agents must keep a digital and physical record of the goods purchased by the consumer so that it is not necessary to present the invoice or the product warranty, in case there is a nonconformity.
In addition, the amendments are intended to empower the Defensoría del Consumidor to sanction businesses that refuse to respond to a buyer for not having the proof of purchase.
