Economy Commission seeks homologation of Administrative Procedures

The Vice Minister of Economy Mario Salazar and the representation of the Superintendencia de Competencia (SC), were present at the Economy Commission in which they continued studying the proposal that contains 24 articles, of which 19 are reforms, one is derogatory and five are new provisions; this represents 41% of adaptations with the Ley de Procedimientos Administrativos (LPA).

The reforms are intended to bring the LC in line with the Ley de Procedimientos Administrativos (LPA), in order to prevent companies from having to interpret more than one law to know the rules for healthy competition in the market.

Deputy Anabel Belloso expressed that soon there will be a debate in which they will study article by article; one of them has to do with administrative silence, the decisions of economic concentrations.

"It seems important to me that we do this work, this commission is in the disposition to support the initiative, which will lead to have a legal framework to give the business sector conditions to promote investment", said the deputy of Nuevas Ideas, Elisa Rosales.

For the reform proposal, both the Ministry of Economy (MINEC) and the SC carried out a broad consultation with 18 State institutions and private companies, to consider and include their points of view.

"We must always seek that the beneficiary is the one who benefits, if not that the terms or other processes go against the interest of the beneficiary and that a procedure will be more complicated than a benefit", said the FMLN deputy, Anabel Belloso.

The Vice Minister of MINEC indicated that they are working on a second block of reforms to the Competition Law to update its substantive provisions, in light of best international practices in the field of competition law.
