More than 1,700 companies are denounced to the Fiscalía General de la República for withholding AFP fees

According to the Ministerio de Trabajo y Previsión Social, 1,700 companies have been reported for withholding workers' contributions to the AFP (Pension Fund Administrators), a situation that affects more than 109,000 workers.

The recently approved Integral Law of the Pension System, an initiative of the Executive, guarantees that no employer will appropriate the social security contributions deducted from employees, as has occurred with the previous system by some bad businessmen. It establishes fines, in some cases of US$600, for non-declaration, incomplete declaration or non-payment of contributions.

Through this portfolio of State, support has been provided to denounce this type of non-compliance with labor regulations. The cases are investigated by the Fiscalía General de la República (FGR) and, thanks to the processing of complaints, some of those prosecuted for this crime are already in prison.

The social security debt is originated when the bad companies do not contribute the 8.75% established by the Law and, in addition, withhold the contributions deducted from the workers, being these affected, since they will have to work longer in order to retire.

Some employers have been prosecuted and have had to pay what was owed, others are in prison for having appropriated withholdings made from workers.

Taking possession of the amounts deducted from the workers, besides hitting the pension fund, causes irreversible damage to the workers, who have to work for more than four years to be able to retire.
