Renewal of the Competition Law will seek to provide legal certainty to companies

The Legislative Assembly approved the package of reforms to the Competition Law (LC), with this law will seek to facilitate healthy competition among companies operating in the country, favor the interpretation of the LC and the Administrative Procedures Law (LPA) at the time of its application and safeguard the legal certainty of companies.

The renewal of the Competition Law contemplates the reform of 19 articles, the repeal of one article and the incorporation of 5 new ones. The main objective of the reformulation of this regulatory body is to harmonize the procedures of the LC with the provisions of the LPA, in addition to incorporating technological innovation, granting validity to the electronic processing of some processes.

With this reform to the LC they seek to promote a favorable climate for investment, which can bring benefits to the population, the reduction of procedures and the legal certainty provided to companies generates that the SC is at the forefront of the defense of healthy competition in the national territory.

The package of reforms to the LC approved was widely consulted with the public and business sector and includes relevant issues such as the modernization of processes to reduce red tape, an action that is aligned with the vision of economic growth and modernization of the State.

This is the first set of reforms that the Ministry of Economy (MINEC) and the SC present to the Competition Law. The reforms approved by the plenary this day are adjective and procedural.

Next year the authorities intend to present another set of substantive reforms to the regulation to continue strengthening and promoting healthy competition among companies and continue on the path of turning El Salvador into a prosperous, dynamic, modern, supportive and inclusive economy, capable of creating opportunities for personal, community and social development for all people in society.
